Terms of Service

These Terms of Service (“Terms”) govern your access to and use of freemathplay.comand any related services (collectively, the “Service”) operated by FreeMathPlay (“we”, “our”, “us”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You may use the Service only if you can form a legally binding contract under applicable law. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Description of the Service

The Service is an online portal that provides access to free-to-play HTML5 math and arcade games embedded from third-party game providers. The Service is supported by advertising and may display advertisements within games and across the website.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. License to Use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial entertainment and educational use, subject to these Terms.

Except as expressly permitted, you agree not to:

We reserve the right to terminate your access for any breach of these Terms.

4. Intellectual Property

4.1 Our Content

The Service and all of its original content (excluding embedded third-party games), including text, graphics, logos, design, layout, software, and trademarks, is owned by FreeMathPlay or its licensors and is protected by copyright, trademark, and other intellectual property laws.

4.2 Third-Party Games

Games made available through the Service are owned by their respective developers or publishers and are embedded under the licensing terms of the relevant game-distribution platforms. We do not claim ownership of these games. All rights remain with their respective owners.

4.3 Copyright Concerns

If you believe content on the Service infringes your copyright, please see our DMCA Policy for instructions on submitting a takedown notice.

5. Third-Party Content and Advertising

The Service displays content from third parties, including embedded games and advertisements served by advertising networks (such as GameMonetize and, in the future, other ad networks). We do not endorse and are not responsible for the content, accuracy, or practices of third-party games, ads, or linked websites. Your interactions with third parties are solely between you and that third party.

6. User Submissions

If you submit any feedback, suggestions, ideas, or other content to us (collectively, “Submissions”), you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, reproduce, distribute, and create derivative works from such Submissions for any purpose, without compensation to you. You represent that you have all rights necessary to grant this license.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • Defects will be corrected.
  • The Service or the servers that make it available are free of viruses or other harmful components.
  • Any content, including third-party games, will be accurate, reliable, or appropriate for your needs.

Your use of the Service is at your sole risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FREEMATHPLAY, ITS OPERATORS, OWNERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless FreeMathPlay and its operators, owners, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party right, including any intellectual property or privacy right.

10. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including breach of these Terms, without notice or liability. Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Morocco, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts located in Marrakesh, Morocco, except where applicable law grants you the right to bring action in your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes will be communicated through a notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and DMCA Policy, constitute the entire agreement between you and FreeMathPlay regarding the Service and supersede any prior agreements.
